Terms and Conditions

Stated below are our general Terms and Conditions, Wedding Terms and Conditions are available on request.

1. Our Products

1.1 All items shown for sale are available for local delivery to the areas (NR13 and surrounding areas.)

1.2 We aim to deliver some flowers in bud to increase vase life.

1.3 Floral products are subject to availability. If we are unable to supply your chosen item we reserve the right to substitute a product of equivalent value and quality without notice.

1.4 If we are unable to provide your chosen item or a suitable substitution we will advise you as soon as possible and refund your payment in full.

1.5. Arrangements delivered may be photographed for use on La Belle Flowers promotion material, unless specifically stated otherwise by the client

2. Prices

2.1 Prices listed are valid for a maximum of 14 days after placing your order.

2.2 Quoted product prices are the total cost but exclude delivery charges Deliveries will be subject to a £5.95 delivery charge.

3. Orders / Payment

3.1 In order to fulfill your order we require all necessary fields stated when ordering. We accept payment by all major credit and/or debit cards. By submitting your order and payment details, you are consenting to be bound by our terms and conditions contained in these Terms and Conditions and appearing anywhere on the site labelleflowers.co.uk

3.2 Submitting your order is subject to our acceptance of this offer when we issue a written confirmation of acceptance by e-mail to the e-mail address with which you have supplied. This message will re-confirm the total cost of your order. We will not consider ourselves bound by a contract with you until we have issued this confirmation, your payment has cleared and we have confirmed delivery coverage for your order.

4. Delivery

4.1 Delivery charges (£5.95) will be applicable to addresses within our local delivery areas as linked to above.

4.2 Timed deliveries are not available, should a timed delivery therefore be requested we will not be bound in any way to honour such a request.

4.3 On acceptance by us of your Order we will advise you by e-mail confirmation of the intended delivery date.

4.4 Where incorrect personal and delivery details have been supplied problems or delays in delivery may result, therefore please ensure that you have included the full address details, including accurate postcode of the intended recipient and your daytime telephone number or e-mail address so that we can notify you in the event that any delivery problems occur.

4.5 Where a third party is involved during delivery, such as hospitals, airports, hotels and ships, the signature of any person authorised to accept delivery on behalf of the organisation shall be accepted as proof of delivery to your chosen recipient.

4.6 In the instance of there being difficulties in delivering your order to the intended recipient we (including the florist or third party delivering your order) reserve the right to contact the recipient using the contact details you provided.

4.7 On ordering we allow you to specify additional delivery information where such guidance may be helpful – for example to a floor number, hospital ward or other relevant property details. We reserve the right to not action any delivery requests specified in this field which we deem unacceptable such as requests for timed orders etc.

5. Cancellation

5.2 To amend or cancel your order, please contact us on 01603 211477. We can not guarantee a refund will be given.

6. Customer Services

(Please do not throw your flowers away, we will need to collect them and check for problems.)

6.2 Because of the perishable nature of our products in order to assist us in resolving any complaints quickly and to our mutual satisfaction, we advise you to make any complaint within 1 working day of the date of delivery or on delivery of your purchase, we can not deal with complaint after this time.

7. Disclaimer

7.1 Whilst we agree to use our reasonable endeavours to ensure that the site and/or the service is fully operational and error-free we cannot guarantee this and, therefore, accept no responsibility for any defects and/or interruption of the site and/or our service and shall be released from our obligations under these Terms and Conditions in the event of any cause beyond our reasonable control which renders the provision of the site and/or our service impossible or impractical.

8. General

8.1 We reserve the right to amend the Terms and Conditions on which you are permitted access to this site and/or our service when we see fit. The Terms and Conditions in force will be those as displayed on this site at the time and date your order is placed. We require that you always read these terms and conditions before placing your order and we provide a link on the product page you have chosen to these terms and conditions.

8.2 Additionally, we reserve the right to suspend, restrict or terminate access to the Site and/or our services for any reason at any time.

8 .3 These Terms and Conditions shall be deemed to include all other notices, policies, disclaimers and other terms contained in the site, provided that in the event of a conflict between any such other notices, policies, disclaimers and other terms, these Terms and Conditions shall prevail. If any of these Terms and Conditions is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

8.4 We shall ensure that we comply with the requirement of all current data protection legislation including, without limitation, the Data Protection Act 1998 (as replaced, modified or re-enacted from time to time). We shall only use personal data received from you for the purpose of fulfilling our obligations under these Terms and Conditions.

8.5 A person who is not a party to the agreement between you and us has no rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any of the Terms and Conditions but this does not affect any right or remedy which exists apart from that Act.

8.6 Save in respect of fraudulent misrepresentation, this agreement (including any documents and instruments referred to herein) supersedes all prior representations, arrangements, understandings, and agreements between you and us (whether written or oral) and sets forth the entire agreement and understanding between you and us relating to the subject matter hereof.

8.7 Your purchase will be deemed to have occurred in the UK. These Terms and Conditions shall be governed by and construed in accordance with English Law and the parties agree to submit to the exclusive jurisdiction of the English courts.

8.8 Your access to the Site and Service may be occasionally restricted to allow for routine maintenance.
